Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “Client”) and GraceSettle LLC, a Texas limited liability company (“GraceSettle,” “we,” “us,” or “our”). By creating an account, starting a case, or otherwise using our website and services (the “Service”), you agree to be bound by these Terms.

1. Overview of Services

GraceSettle provides after-loss estate administration assistance, including but not limited to:

  • Government notifications (Social Security Administration, IRS, DMV, and other agencies)
  • Benefits discovery and claims filing
  • Account closures, transfers, and notifications to financial institutions, utility companies, and subscription services
  • Document preparation, generation, and (for Full Service plans) mailing and submission on your behalf
  • Case tracking through a personalized online dashboard

2. We Are Not a Law Firm

GraceSettle is not a law firm, and nothing in our Service constitutes legal advice, tax advice, or financial advice. We provide administrative assistance with paperwork, filings, and correspondence. We do not represent you in court, provide opinions on legal rights or obligations, or act as your attorney, CPA, or financial advisor.

If your situation requires legal, tax, or financial counsel, we strongly recommend consulting a licensed professional. We may suggest you consult an attorney when we identify issues outside our scope, but such suggestions do not constitute legal advice.

3. Eligibility

  • You must be at least 18 years of age.
  • You must be a lawful heir, executor, personal representative, or otherwise legally authorized to act on behalf of the deceased’s estate.
  • Our Service is currently available for estates in the state of Texas. We may expand to additional states in the future.
  • You represent that all information you provide is true, accurate, and complete to the best of your knowledge.

4. Free Trial, Pricing, and Payment

4.1 Free Trial

New cases begin with a free 3-day trial. During the trial, we generate your case plan and begin initial filings. No payment information is required to start the trial.

4.2 Service Tiers

  • Guided ($99): We generate all documents, letters, forms, and call scripts. You review, print, mail, and make calls using our instructions and dashboard.
  • Full Service ($399): Everything in Guided, plus we mail letters via certified mail, send emails, submit online forms, and make calls on your behalf. You review and approve.

You may upgrade from Guided to Full Service at any time for the price difference ($300). Prices are subject to change; any changes will not affect cases already in progress.

4.3 Payment

Payments are processed securely via Stripe. By providing payment information, you authorize us to charge the applicable fee. All fees are in US dollars.

4.4 Refund Policy

If you are not satisfied with our Service, you may request a refund within 14 days of payment, provided that no filings have been submitted to government agencies or institutions on your behalf. Once filings have been initiated, refunds are prorated based on work completed. Refund requests should be sent to support@gracesettle.com.

5. Your Responsibilities

  • Accurate information: You agree to provide truthful, accurate, and complete information. Inaccurate information may delay or prevent filings.
  • Legal authorization: You represent that you have the legal authority to act on behalf of the estate and to share the deceased’s personal information with us.
  • Timely responses: Certain filings have legal deadlines. While we track and notify you of deadlines, delays in your responses or approvals may affect outcomes.
  • Document review: You are responsible for reviewing documents before they are submitted (Guided tier) or approving them for submission (Full Service tier).
  • Account security: You are responsible for maintaining the confidentiality of your dashboard access link and promptly notifying us if you believe unauthorized access has occurred.

6. Authorization to Act on Your Behalf

By using the Full Service tier, you grant GraceSettle a limited authorization to:

  • Correspond with government agencies and institutions regarding the deceased’s accounts and filings
  • Submit forms, letters, and notifications that you have reviewed and approved
  • Mail physical documents via certified mail on your behalf

This authorization does not grant us power of attorney. We act strictly as an administrative service provider carrying out your explicit instructions.

7. Limitations and Disclaimers

  • No guaranteed outcomes: We cannot guarantee that any particular filing will be accepted, that benefits will be awarded, or that accounts will be closed within a specific timeframe. Government agencies and institutions have their own processing requirements and timelines.
  • Scope limitations: We do not handle litigation, contested estates, real property transfers requiring court orders, or matters that require a licensed professional.
  • Third-party dependencies: Our ability to complete filings depends on third-party institutions responding in a timely manner.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRACESETTLE’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO GRACESETTLE IN THE 12 MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL GRACESETTLE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST BENEFITS, LOST DATA, OR LOST OPPORTUNITIES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Intellectual Property

All content, software, trademarks, and materials on the Service are owned by or licensed to GraceSettle. You may not reproduce, distribute, or create derivative works without our written consent.

Documents generated specifically for your case (letters, forms, filings) are provided for your use in connection with your estate administration and may be retained by you.

10. Termination

You may discontinue use of the Service at any time by contacting us. We may suspend or terminate your access if we reasonably believe you have violated these Terms, provided inaccurate information, or engaged in fraudulent activity.

Upon termination, we will retain your data in accordance with our Privacy Policy and applicable law. Sections 2, 7, 8, 11, and 12 survive termination.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Service shall first be submitted to good-faith mediation. If mediation fails, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Austin, Texas.

Class action waiver: You agree to resolve disputes on an individual basis. You waive the right to participate in any class action, collective action, or representative proceeding.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance. If you disagree, you may terminate your account.
